Gyro – Terms of Use

1. Our Mission

GYRO aims to make maritime education engaging and accessible through interactive quizzes, tests, challenges, and peer reviews.
The content in GYRO is educational in nature and must not be relied upon as professional navigation advice or official certification material.
We are not an accredited maritime training organization.

2. Eligibility

You may use GYRO only under the following conditions:

• You are at least 16 years old. If you are between 16 and 17 years of age, use of the platform is permitted with the consent or under the supervision of a parent or legal guardian;
  
  
• You have the legal capacity to enter into this Agreement;
  
  
• You are a seafarer, cadet, student of a maritime educational institution, or a professional affiliated with the maritime industry, or are otherwise legitimately involved in maritime education, training, or operations;
  
  
• You use the platform solely for educational, professional, or lawful purposes related to maritime activity, and not for spam, fraud, or any other improper conduct.
  
  

GYRO is an online platform for seafarers and individuals interested in maritime affairs, but it is not an accredited educational institution or an official training organisation.
We may require additional verification of your maritime status (for example, qualification documents, a seafarer’s ID, records of sea service, or proof of affiliation with a maritime organisation).
Accounts that cannot verify their connection to the maritime field may be restricted or suspended.

If you are using GYRO on behalf of an organisation, you confirm that you are duly authorised to act on its behalf and that such organisation operates within the field of maritime services, training, or education.

3. Account Registration & Security

• You must create an account to access most features of GYRO.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• If you believe your account has been compromised, contact support immediately at info@gyro.team 
• GYRO reserves the right to suspend or terminate accounts that violate these Terms, engage in fraud, or harm other users.

4. Content and Intellectual Property

4.1 GYRO Content

All materials provided by GYRO—including quizzes, graphics, design, logos, software, and text—are the exclusive property of GYRO or its licensors.
You may not copy, reproduce, modify, distribute, or create derivative works from our content without written consent.

4.2 User-Generated Content (UGC)

GYRO allows users to upload or submit content such as reviews, feedback, and comments (“User Content”).
By submitting User Content, you grant GYRO a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable license to use, display, translate, and distribute that content within the app and related promotional materials.

You retain ownership of your content, but you agree that:

• You have the right to share it;
• It does not violate any third-party rights or confidentiality obligations;
• It is accurate, non-defamatory, and lawful.

4.3 Content Moderation

We reserve the right to remove, edit, or restrict access to User Content that violates these Terms, community standards, or applicable law.

5. Prohibited Conduct

You agree not to engage in any of the following actions:

• Use GYRO for any unlawful, fraudulent, or deceptive purpose;
  
  
• Upload, post, or share offensive, defamatory, discriminatory, or harmful content;
  
  
• Attempt to gain unauthorised access to other users’ accounts or to any part of our systems;
  
  
• Reverse-engineer, copy, decompile, or modify GYRO software or any component of it;
  
  
• Share or publish false, misleading, or unverified information in reviews, ship reports, or community posts;
  
  
• Use bots, scripts, automated systems, or any manipulative techniques to alter results, rankings, or competition outcomes.
  
  

Violation of these rules may result in temporary suspension or permanent termination of your account, at GYRO’s sole discretion.
If your actions cause financial, reputational, or operational damage to GYRO or to other users, you may be required to compensate for such damages in full, including reasonable administrative, investigative, and legal costs incurred as a result of your misconduct.
GYRO reserves the right to pursue legal remedies for any proven loss or harm arising from violations of these Terms.

6. Subscriptions, Payments & Virtual Items

6.1 Subscriptions

Certain features require a paid subscription. Subscription options (monthly, 3-month, annual) are available via the Apple App Store and Google Play Store.
Subscriptions automatically renew unless cancelled through your store account settings before the next billing cycle.

6.2 Knots (In-App Points)

“Knots” (KN) are GYRO’s virtual points used to unlock tests, participate in competitions, and redeem partner rewards.
Knots are not real currency, have no cash value, and cannot be exchanged or transferred outside the platform.

6.3 Payments & Refunds

All payments are processed by Apple or Google.
Refunds are subject to the rules of the respective platform and applicable consumer laws:

• Apple App Store: request via Apple’s “Report a Problem” page.
• Google Play: refund requests within 48 hours handled by Google; after that, contact GYRO support.
  Under the Australian Consumer Law (ACL), you are entitled to a replacement, repair, or refund if a service fails to meet consumer guarantees.

7. Educational Disclaimer

The quizzes, questions, and materials in GYRO are designed for self-study and practice.
GYRO does not guarantee that completion of any test or course will lead to certification, promotion, or compliance with maritime regulations.
Use of GYRO does not replace official maritime education, navigation systems, or professional advice.

8. Device Use and Technical Risks

You are responsible for ensuring that your device is compatible with the app.
GYRO is not responsible for:

• Data loss, device malfunction, or reduced performance due to improper installation or third-party software;
• Connectivity issues, outages, or service interruptions beyond our control.
  This limitation does not exclude your rights under the Australian Consumer Law.

9. Termination

You may stop using GYRO at any time by deleting your account.
We may suspend or terminate your access if you:

• Violate these Terms or any applicable laws;
• Engage in fraudulent or harmful behavior;
• Misuse Knots or manipulate competitions.

Upon termination, all rights granted to you under these Terms will cease, and unused Knots may be forfeited.

10. Limitation of Liability

To the maximum extent permitted by law:

• GYRO is not liable for indirect, incidental, or consequential losses arising from your use of the service.
• Our total liability is limited to re-supplying the service or refunding the equivalent cost, as required by Australian Consumer Law.

Nothing in these Terms excludes any non-excludable rights or guarantees provided by law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Victoria, Australia.
If a dispute arises, please contact us first at info@gyro.team .
If unresolved, both parties agree to attempt mediation before pursuing court action.
Any legal proceedings shall take place in the courts of Victoria.

12. Changes to These Terms

We may update these Terms to reflect legal, technical, or business changes.
We will notify users of significant updates via in-app notice or email.
Your continued use of GYRO after changes become effective means you accept the updated Terms.
