GYRO – Terms of Use
Welcome to GYRO, a mobile and web platform designed for seafarers to learn, compete, and share professional maritime knowledge.
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and GYRO Team, an Australian company (“GYRO”, “we”, “us”, or “our”), the operator of the GYRO mobile and web application (“App”).
By downloading, accessing, or using the GYRO App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.
1. Our Mission
GYRO aims to make maritime education engaging and accessible through interactive quizzes, knowledge tests, challenges, and peer reviews.
All content in the app is educational and must not be relied upon as official navigation guidance, safety instructions, or certification material.
GYRO is not an accredited maritime training institution, and use of the platform does not replace professional training or certification.
2. Eligibility
You may use the GYRO platform only if allthe following conditions are met:
- You are at least 16 years old. If you are between 16 and 17, you may use the platform with the consent or supervision of a parent or legal guardian;
- You have the legal capacity to enter into this Agreement;
- You are a seafarer, cadet, maritime student, or a professional affiliated with the maritime industry, or otherwise legitimately engaged in maritime education, training, or operations;
- You agree to use the platform solely for educational, professional, or lawful purposes related to maritime activity and not for spam, fraud, or any unlawful or deceptive conduct.
GYRO is an open learning and communication platform for the maritime community but is not an accredited educational institution or an official training provider.
We may, at our discretion, request verification of your maritime status (for example, qualification certificates, seafarer ID, records of sea service, or proof of employment in the maritime sector). Accounts that fail to demonstrate a legitimate maritime connection may be restricted or suspended.
If you use GYRO on behalf of an organisation, you confirm that you are authorised to act on its behalf and that the organisation operates within the maritime field (training, shipping, or related services).
3. Account Registration & Security
To access most of the app’s features, you must create a personal account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

GYRO reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm other users or the platform.
4. Content and Intellectual Property
4.1 GYRO Content
All materials within the GYRO app—including quizzes, text, graphics, designs, software, and logos—are the exclusive property of GYRO or its licensors.
You may not copy, reproduce, modify, distribute, or create derivative works from our content without written consent.
4.2 User-Generated Content (UGC)
The platform allows users to submit content, such as reviews, feedback, or comments (“User Content”).
By submitting User Content, you grant GYRO a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable license to use, display, translate, and distribute your content within the app and related promotional materials.
You retain ownership of your content but agree that:
- You have the legal right to share it;
- It does not infringe on any third-party rights or confidentiality obligations;
- It is accurate, lawful, and non-defamatory.
4.3 Content Moderation
GYRO reserves the right to remove, edit, or restrict access to User Content that violates these Terms, community standards, or applicable laws.
5. Prohibited Conduct
You agree not to:
- Use the GYRO app for any unlawful, fraudulent, or deceptive purpose;
- Upload or share offensive, discriminatory, defamatory, or harmful material;
- Attempt to gain unauthorised access to other accounts or our systems;
- Reverse-engineer, copy, decompile, or modify the GYRO software or any of its components;
- Post false, misleading, or unverified information in ship reviews, reports, or community sections;
- Use bots, scripts, or automation to influence rankings, competitions, or outcomes.
Violation of these rules may result in temporary suspension or permanent account termination at GYRO’s discretion.
If your actions cause financial or reputational damage to GYRO or others, you may be held liable for such damages, including administrative and legal costs.
6. Subscriptions, Payments & Virtual Items
6.1 Free Trial and Paid Plans
When a new user registers in the GYRO app, they automatically receive a 14-day free Platinum subscription, which unlocks all premium features.
No payment details are required to start the trial period.
After the 14 days expire, the subscription ends automatically — it is not renewed automatically.
At the end of the trial, users receive an in-app notification and an email reminder inviting them to manually renew or purchase a new subscription plan (1-month, 3-month, or 12-month). Purchases are made securely through the Apple App Store or Google Play Store, depending on the user’s device.
6.2 Manual Subscription Renewal
All GYRO subscriptions are non-recurring.
Users must manually initiate a purchase each time they wish to renew their plan.
There are no automatic charges or renewals without user action.
6.3 Payments & Refunds
All payments are processed by Apple or Google according to their respective store policies.
Refund requests can be made directly through:
- Apple: reportaproblem.apple.com
- Google: via Google Play support within 48 hours of purchase.
GYRO does not collect or store any payment information.
Refunds are handled exclusively through the respective app store and in accordance with applicable consumer protection laws.
6.4 Virtual Points (“Knots”)
“Knots” (KN) are GYRO’s internal virtual points used to access quizzes, compete, and redeem partner offers.
Knots have no real monetary value, cannot be exchanged for cash, and may not be transferred outside the platform.
Their usage and earning conditions are explained in the in-app Knots Policy.
7. Educational Disclaimer
The quizzes, questions, and materials in GYRO are designed for self-study and practice. GYRO does not guarantee that completion of any test or course will lead to certification, promotion, or compliance with maritime regulations.
Use of GYRO does not replace official maritime education, navigation systems, or professional advice.
8. Device Use and Technical Risks
You are responsible for ensuring that your device is compatible with the app. GYRO is not responsible for:
- Data loss, device malfunction, or reduced performance due to improper installation or third-party software;
- Connectivity issues, outages, or service interruptions beyond our control.
- This limitation does not exclude your rights under the Australian Consumer Law (ACL).
9. Termination
You may stop using GYRO at any time by deleting your account.
We may suspend or terminate your access if you:
- Violate these Terms or any applicable laws;
- Engage in fraudulent or harmful behavior;
- Misuse Knots or manipulate competitions.
Upon termination, all rights granted to you under these Terms will cease, and unused Knots may be forfeited.
10. Limitation of Liability
To the maximum extent permitted by law:
- GYRO is not liable for indirect, incidental, or consequential losses arising from your use of the service.
- Our total liability is limited to re-supplying the service or refunding the equivalent cost, as required by the Australian Consumer Law.
Nothing in these Terms excludes any non-excludable rights or guarantees provided by law.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Victoria, Australia.
If a dispute arises, please contact us first at info@gyro.team.
If unresolved, both parties agree to attempt mediation before pursuing court action.
Any legal proceedings shall take place in the courts of Victoria, Australia.
12. Changes to These Terms
We may update these Terms to reflect legal, technical, or business changes.
We will notify users of significant updates via in-app notice or email.
Your continued use of GYRO after such changes become effective means you accept the updated Terms.
13. Apple Standard End User License Agreement (EULA)
For users who download the app from the Apple App Store, this Agreement incorporates and is subject to Apple’s Standard End User License Agreement (EULA).
In the event of any conflict between these Terms and Apple’s EULA, the EULA shall prevail for iOS users.
